A BILL to amend chapter six-b of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, by adding
thereto a new article, designated article two-b, relating to
the jurisdiction of the Kanawha county prosecutor; and
requiring the prosecutor to investigate allegations of
wrongdoing by state elected and appointed officials.
Be it enacted by the Legislature of West Virginia:
That chapter six-b of the code of West Virginia, one
thousand nine hundred thirty-one, as amended, be amended by
adding thereto a new article, designated article two-b, to read
as follows:
ARTICLE 2B. PROSECUTION OF CRIMES COMMITTED BY STATE OFFICIALS.
§6B-2B-1. Jurisdiction of the Kanawha County prosecutor.
Notwithstanding any other provision of the code to the
contrary, the Kanawha County prosecuting attorney shall have
concurrent authority to investigate and shall investigate any
allegation of wrongdoing by any elected or appointed stategovernment official or employee. The funds necessary to meet the
requirements of this section shall be in an amount not to exceed
one hundred fifty thousand dollars as appropriated to the Kanawha
County prosecutor's office by the Legislature.
§6B-2B-2. Appointment of deputy prosecuting attorney to
investigate wrongdoing in state government.
The Kanawha County prosecutor shall appoint a special deputy
prosecutor with the sole duty of investigating and prosecuting
allegations of wrongdoing by elected and appointed officials and
employees of state government.
NOTE: The purpose of this bill is to confer jurisdiction on
the Kanawha County prosecutor and requiring the prosecutor to
investigate allegations of wrongdoing by state elected and
appointed officials.
